This week I’m talking to Anna Miskelly. Anna did her degree in Civil Law & Society in DCU. She wrote her paper this year entitled “Judicial Formalism versus Institutionalism: The Case of Judicial Enforceable Socio-Economic Rights in Ireland”. This paper looks at how Judges treat cases which may deal with Socio-economic rights in Ireland. Can a judge enforce these rights? How are they laid out in our constitution? What kind of ideologies do judges form their decision processes with? What are socio-economic rights?
